A power of attorney is often treated as a product: choose a template, fill in the names, notarize it and send it abroad. That workflow is convenient for the person producing the document, but it is backwards for the client. The document only has value if a specific Ukrainian notary, registry, bank, company or other recipient can use it for the intended act.
Start with the end state. Is the representative selling one apartment, collecting a record, signing a corporate filing, dealing with an inheritance file, receiving documents or performing several linked steps? List those acts in plain language before anybody drafts clauses. That list becomes the specification against which the Ukraine-side professional can review authority.
A vague “general” power can be simultaneously broad and unusable. It may sound comprehensive but omit the one authority the receiving professional needs: signing a particular agreement, filing a registry application, receiving a certificate, dealing with a payment step or acting before a named institution. The failure is usually discovered after notarization and apostille, when the expensive part of the route is already irreversible.
The fix is not to make every POA enormous. It is to make the authority deliberate. Some files benefit from a narrow single-purpose instrument. Others genuinely need a broader chain of acts. The right breadth comes from the real transaction and the receiving professional, not from copying every clause that appeared in the last template.
Once the wording is agreed, freeze the final version before Canada-side signing. The notarized document, the apostilled document and the translated document should be traceable to the same final text unless the route intentionally requires a different transformation. Tiny version drift — an edited authority clause, changed transliteration or outdated property detail — can make the file difficult to audit later.
A clean POA file therefore keeps the approved draft, executed original, apostille, translation and delivery record together. The point is not bureaucracy. It is being able to prove exactly what the representative was authorized to do and which version the Ukrainian recipient relied on.
